1. Introduction and Scope

These Terms and Conditions govern the use of tourist car rental services provided by Nomatrek ("we", "us", "our"), operating from 47 Jalan Kampung Air, 88000 Kota Kinabalu, Sabah, Malaysia. By submitting an enquiry or entering into a rental arrangement with Nomatrek, you ("the renter") agree to these terms.

These terms apply to all three service packages: Day-Trip Compact Tourist (RM 500), Mid-Stay Sedan Tourist (RM 1,900), and Two-Week Touring Package (RM 4,500). Where specific conditions apply to a particular package, they are noted within the relevant section.

These terms are governed by Malaysian law. Any disputes arising from rental arrangements with Nomatrek will be subject to the jurisdiction of the courts of Sabah, Malaysia.

2. Eligibility and Licensing Requirements

To rent a vehicle through Nomatrek, the renter must:

  • Be aged 21 years or older at the time of rental
  • Hold a valid driving licence issued in their country of residence
  • Hold an International Driving Permit (IDP) if their licence is not issued in English or Malay
  • Have held a valid driving licence for a minimum of two years
  • Present valid passport or identification documents at the time of vehicle collection

Nomatrek reserves the right to decline any rental arrangement where eligibility requirements are not met at the time of handover.

3. Rental Packages and Inclusions

Each package is described below. Inclusions are provided as part of the service arrangement and are subject to preparation lead time prior to the rental start date.

Day-Trip Compact Tourist (RM 500)

  • Compact vehicle for up to one full day of use
  • City map pack covering Kota Kinabalu and surroundings
  • Route suggestion sheet for first-time visitors
  • Printed quick-reference card for Malaysian road conventions
  • Vehicle handover and return at our Jalan Kampung Air address

Mid-Stay Sedan Tourist (RM 1,900)

  • Mid-size sedan for up to seven days of use
  • Multi-day route plan prepared based on stated travel itinerary
  • Stopover suggestions between major cities along agreed corridors
  • Pickup point of choice within Klang Valley (subject to prior arrangement)

Two-Week Touring Package (RM 4,500)

  • Touring vehicle for up to fourteen days of use
  • Itinerary-based route plan prepared prior to departure
  • Mid-trip vehicle review at an agreed location (day 7–9 of the rental period)
  • Mileage-tracking reports provided at mid-trip review and upon return
  • End-of-trip summary document suitable for travel documentation purposes

4. Pricing and Payment

All stated prices are in Malaysian Ringgit (RM) and are inclusive of the base vehicle arrangement and inclusions described in Section 3. Prices do not include:

  • Fuel costs during the rental period
  • Toll charges incurred during use
  • Parking fees
  • Any fines or penalties issued by Malaysian authorities during the rental period
  • Optional add-ons agreed separately in writing prior to the rental start date

Payment terms and accepted methods will be confirmed in the rental confirmation correspondence. Nomatrek will provide written confirmation of the agreed amount before the rental start date. Prices are subject to change for new enquiries; confirmed rental arrangements retain their agreed pricing.

5. Vehicle Use and Renter Responsibilities

During the rental period, the renter is responsible for:

  • Using the vehicle in accordance with Malaysian road regulations
  • Maintaining appropriate fuel levels throughout the rental period
  • Returning the vehicle in the same condition as collected, subject to normal use
  • Reporting any damage, incident, or mechanical concern to Nomatrek promptly
  • Not permitting any driver other than the named renter to operate the vehicle, unless agreed in writing before the rental period begins
  • Not using the vehicle outside of Peninsular Malaysia, Sabah, or Sarawak without prior written agreement

The vehicle must not be used for purposes other than standard tourist travel and personal transport. Commercial use, racing, or off-road driving are not permitted.

6. Vehicle Condition and Damage

A vehicle condition report will be completed jointly at the time of handover. The renter is asked to review and acknowledge this report before taking possession of the vehicle.

Any damage that occurs during the rental period and that was not recorded in the pre-rental condition report is the renter's responsibility. Nomatrek will assess the cost of repairs and communicate this in writing after the return of the vehicle.

In the event of an accident or incident involving a third party, the renter must: notify the relevant Malaysian authorities as required by law; obtain a police report where applicable; and inform Nomatrek by phone at +60 12-518 9437 as soon as reasonably practicable.

7. Insurance and Liability

Vehicles provided through Nomatrek are covered by standard Malaysian motor insurance in accordance with legal requirements. The scope of this coverage will be outlined in the rental documentation provided at handover.

Nomatrek is not liable for loss or damage to the renter's personal property, including luggage and electronics, during the rental period. Renters are encouraged to arrange appropriate travel insurance prior to their arrival in Malaysia.

Nomatrek's liability under any rental arrangement is limited to the scope permitted by applicable Malaysian law and does not extend to indirect or consequential losses.

8. Cancellations and Modifications

Renters wishing to cancel or modify a confirmed rental arrangement should contact Nomatrek by email at [email protected] or by phone at +60 12-518 9437.

Cancellation terms will be outlined in the rental confirmation correspondence and may vary based on the package and the notice period provided. Modifications to the rental start date, duration, or pickup location are subject to availability and may affect pricing.

Nomatrek reserves the right to cancel a rental arrangement in circumstances beyond our reasonable control, including vehicle unavailability due to mechanical failure. In such cases, Nomatrek will endeavour to provide a comparable alternative or arrange a refund of any amounts paid.

9. Route Materials and Documentation

Route plans, stopover suggestions, and travel reference materials provided as part of Nomatrek's packages are prepared based on information available at the time of enquiry. They are intended as guidance only and do not constitute navigation advice for real-time road conditions.

Nomatrek is not responsible for changes to road conditions, closures, or access restrictions that may occur after route materials are prepared. Renters remain responsible for verifying current conditions independently during their journey.

The end-of-trip summary document provided under the Two-Week Touring Package reflects recorded mileage and agreed waypoints. It is provided as a travel record and is not a legal document.

10. Enquiry Process

Submitting an enquiry through our website or contacting us by email or phone does not constitute a binding rental agreement. A rental arrangement is confirmed only upon written confirmation from Nomatrek, including agreed pricing, rental dates, and package details.

11. Governing Law and Disputes

These Terms and Conditions are governed by the laws of Malaysia. Any dispute arising from or in connection with a rental arrangement that cannot be resolved through direct communication will be referred to the courts of Sabah, Malaysia.

We encourage renters to raise any concerns with us directly in the first instance. We will make reasonable efforts to resolve concerns promptly and fairly.
